Phone & Absentee Bids

  1. Telephone and absentee bid forms must be received 24 hours prior to auction. Bidders are responsible to verify Grant Zahajko Auctions, l.l.c. has received their bid form.
  2. No telephone bids are accepted for less than $250.00. Absentee bids accepted for under $250.00.
  3. Bidders should examine lots offered or request a condition report as all items are sold as-is, unless otherwise stated.
  4. Bidders agree to accept our Terms of Auction when bidding. A 16% Buyer’s Premium will be added to all absentee bids and a 21% Buyers Premium will be added to all phone bids.
  5. Grant Zahajko Auctions, l.l.c. will make a good faith effort to accommodate bidders but will not be held responsible for errors or telephone disconnection if such occurs. Grant Zahajko Auctions, l.l.c. will call the telephone bidder as per instructions 3 minutes prior to auction lot being offered.
  6. Winning bids must be paid in full by no later than 48 hours following auction or notification of your winning bid. Items purchased may not be shipped until full payment is made.
  7. Buyer is responsible for all shipping costs and purchasing insurance (if desired). Grant Zahajko Auctions, l.l.c. will not be held responsible for any loss or damage of goods while in transit. We will be happy to work with any shipping company of your choice.

Terms and Conditions

Identification:

All purchasers are required to have a bidder's number or have filled out a valid absentee bidding form. The bid number or absentee form is available at the registration desk or on-line. Bidder numbers will be assigned upon completion of the supplied registration form. The bid card and number is valid for the specific Auction only!

Addition-To, or Withdrawal-From, Sale:

The Auctioneer reserves the right to withdraw from Auction any of the items listed for sale. The Auctioneer also reserves the right to sell at this Auction items not currently listed. Additionally, the Auctioneer reserves the right to group one or more lots into one or more selling lots or to subdivide lots into two or more selling lots. Whenever the best interest of the seller is served, the auctioneer reserves when necessary the right to sell all of the items listed in bulk.

Bidder Disputes:

If any dispute occurs between two (or more) bidders, the Auctioneer may decide the sale. Or the Auctioneer may immediately put the lot up for sale again, and resell to the highest bidder. The decision of the Auctioneer shall be final, fixed and unequivocal.

Reserve:

The Auctioneer reserves the right to reject any and all bids. On lots with a reserve, the auctioneer has the right to bid on behalf of the seller.

Absentee and Phone Bidding:

Phone and Absentee bidders should examine all lots offered as all items are sold as-is. Bidders agree to accept our Terms of Auction when bidding. A 16% Buyers Premium will be added to all Absentee Bids. A 21% Buyers Premium will be added to all Phone bids.

Condition of Items Sold:

The Auctioneer shall not be responsible for the correct description, authenticity, genuineness of, or defect in any lot, and makes no warranty in connection therewith. No allowance will be made, or sale set aside, on account of any incorrectness or error in cataloguing, or any imperfection not noted. No deduction will be allowed on damaged articles as all goods being exposed for public exhibition are sold “as-is” and without recourse.

Payment and Buyer’s Premium:

All invoices must be paid in full before leaving the premises on the day of the auction for in-house bidders, unless other arrangements have been made previous to the auction. Details on making payment are provided in an invoice from the seller that will be sent within 24 hours following the completion of the auction to all on-line platform/phone/absentee bidders. The buyer is responsible for paying the seller directly after winning the item. The seller accepts Visa, Master Card, Discover, American Express and wire transfer. Any invoice totaling over $7500 will require a wire transfer. Payment is due within 4 days following receipt of the invoice for on-line platform, absentee and phone bidders. All on-line platform and phone bids are subject to a 21% buyer's premium and all in-house and absentee bids are subject to a 16% Buyers Premium. All in-state buyers must pay sales tax based upon ship to location on purchases unless a copy of a valid reseller permit or tax exemption is provided.

Compliance with the Terms of Sale:

In default of payment of invoices in full within the time specified, the auctioneer, in addition to all other remedies allowed by law, may retain all moneys received as deposit or otherwise as liquidated damages. Lots not paid for and removed within the time specified herein may be resold at public or private sale without further notice, and any deficiency, together with all expenses and costs of re-sale, will be paid by the defaulting purchaser.

Additional Terms and Conditions:

Any additional terms or conditions of sale, added by Auctioneer, shall be announced prior to the Auction and are binding.

Removal:

Removal shall be at the expense, liability, and risk of the purchaser. Purchases can be removed from premises only upon presentation of a paid invoice. The Auctioneer shall not be responsible for goods not removed within the time specified, and shall have the option of removing and storing at the expense and risk of the purchaser any article purchased.

Non-Delivery Responsibility:

Auctioneer shall not, in any event, be liable for non-removal, or for any other matter or thing, to any purchaser of any lot, other than for the return to the purchaser of the deposit, or sum paid on said lot, should the purchaser be entitled to it.

Claims:

No claims will be allowed after goods are removed from premises.

Personal and Property Risk:

Persons in attendance during exhibition, sale or removal of goods, assume any and all risks of damage of or loss to person and property, and specifically release the Auctioneer from liability therefore. Neither the Auctioneer, Grant Zahajko Auctions, L.L.C., nor their principal, shall be liable in the event of any dispute. The Auctioneer and Grant Zahajko Auctions, L.L.C., may tape record and/or video tape any auction, and the buyer agrees to allow such tape recording and/or video tape to be submitted as evidence in a court of law. Buyers agree to pay all reasonable fees incurred in enforcing these terms.

Agency:

The Auctioneer is acting as agent only and is not responsible for acts of its principals.

Shipping:

The buyer is responsible for paying all shipping costs. At the time you make payment for your item, the auction gallery staff will discuss shipping details with you. We combine items for shipment as possible. We ship via USPS Priority Mail (ground for some exceptions) and Priority Mail Express International for all packages outside of the USA. We also ship via Fed Ex. We require insurance on all packages. We do charge a fee for packaging materials and handling. We will do our best to package all shipments in-house but reserve the right to forward your item to an outside shipper if the item is to large or fragile. We will contact you to help coordinate an outside shipper quote. Our preferred outside shipper is: Action Shipping 11807 E Trent Ave, Spokane, WA 9920. 509-926-2445.
